The effective defense sprays against humans and animals
The means of choice from the perspective of proportionality
Differing opinions regarding proportionality in self-defense have led to increased demand for suitable means of defense from those potentially at risk, mostly women and teenagers. One of these alternatives is tear gas sprays, also known as defense sprays or irritant sprays. The term "tear gas" is misleading, as the permitted active ingredients are not gases, but exclusively crystalline solids or liquids applied in spray form.
1. Required Properties
Such sprays must, of course, effectively protect the victim while causing as little physical harm to the attacker as possible. This limitation may seem absurd, but according to some court reports we have received, in which the victim was suddenly branded the perpetrator, it is entirely appropriate.
What does "proportionate" mean in self-defense? Here are three test cases. Five thugs harass Mr. Müller in a pedestrian zone, demanding money and cigarettes. Help from other passersby is not to be expected. Mrs. Meier is walking a baby in a deserted park when two men approach, become intrusive, and grope her... A drug addict puts a knife to the stomach of the elderly pensioner Schultz and demands money. Assuming that all three victims were in legal possession of a firearm, when would the use of one be "proportionate"?
Is Mr. Müller allowed to draw his weapon to keep the thugs at bay? Is he allowed to pull the trigger if they still attack him? Does Ms. Meier have to endure being groped when the two explain to her that they only wanted a little... Is Mr. Schultz allowed to shoot without prior warning if he feels the tip of the knife on his skin? In all cases: the outcome is uncertain; the prosecutor and judge decide behind closed doors who should have acted how in which situation.
In the cases described, and not only these, defending himself with a firearm could potentially have been fatal for the attacker(s). With a suitable defense spray such as DEFENOL or CS-KO, equally effective protection could have had far milder consequences. So what exactly is a suitable defense spray?
2. Physical Requirements for a Defense Spray
Appendix 2 of the 1st Ordinance to the Weapons Act describes the requirements for irritant sprays. According to this, the irritant sprays can be sprayed in gaseous, aerosol, or dissolved form, but must have a minimum range of 1.5 m. In practice, it is essential that as much active ingredient as possible is sprayed in the highest possible concentration in the narrowest possible spray cone.
At a distance of 1.5 meters, it should not exceed twice the diameter of a person's face. As a general rule, the wetter the spray jet and the higher the spraying rate, the more effective and less susceptible the spray is, even in light headwinds. DEFENOL has a distinctly wet spray jet and fully meets these requirements.
Irritant sprays in lipstick format generally have a comparatively low spray rate, are quickly emptied, and are difficult to target. For this reason, they pose more of a risk than effective protection. 40 and 50 ml doses are reliable and allow for multiple "shots."
